Q: What types of misconduct fall within the jurisdiction of the Code of Conduct?
A: All non-academic student misconduct which occurs on campus is covered by the Code of Conduct.

Q: Does this include traffic violations?
A: Yes. Under the Code of Conduct, the Director of Public Safety is the Traffic Hearing Officer who hears all cases contesting traffic violations. His decisions are final and not subject to review.

Q: What about academic misconduct?
A: Charges of academic violations are adjudicated by the dean of the school or college in which the misconduct may have occurred.

Q: Is judicial advice available for students accused of misconduct?
A: Yes. Once a student is notified of a complaint, he or she has the right to the assistance of a Faculty Judicial Advocate until the conclusion of the case.

Q: What recourse does a student have if he or she is the victim of misconduct?
A: If the person alleged to have committed the misconduct is a student and the violation occurred on campus, the Code of Conduct has jurisdiction and a complaint may be filed. If the person accused is an employee (faculty, staff, or administrator) the Office of Human Resources adjudicates the case.

Q: Where does one go to file a complaint or inquire about the judicial process?
A: The Student Judicial Officer (Earle Hall 100) can answer judicial questions and process complaints.

Q: What should I do if I am the victim of sexual misconduct?
A: In the case of a physical sexual offense which takes place on-campus, contact Public Safety (dial 5) immediately. If off-campus, CALL 911. Students experiencing any form of discrimination or harassment should report such conduct immediately to the Dean of Student Affairs in U.C. 108 or call 516.877.3660.

Q: In a judicial case, who determines whether a charged party is responsible and what the sanction, if any, should be?
A: In cases of violation of Residence Hall Agreement by resident students, the Associate Director of Residential Life and Housing (or his designee) makes that determination. Other charges against resident students and all cases involving commuter students are adjudicated by the Office of the Dean of Student Affairs except when sanctions could include loss of housing, suspension from the University, or expulsion. In that case a University Hearing Board (composed of students, faculty, and administrators) determines responsibility and sanctions, unless the students request that a board not be used.

Q: Is there an appeal process?
A: Yes. In many cases an appeal process is available. Check with the Office of the Dean of Student Affairs in the University Center, room 108, for the specific grounds required for reviews.
